Overview

Disputes are inevitable in almost all the industries. In circumstances where disputes arise, it is necessary to resolve the disputes in a timely and adequate manner, so as to minimize the losses.

Globally, more emphasis is given on arbitration, which is an Alternative Dispute Resolution method, as a way of resolving the disputes. The arbitration has many benefits that traditional ways of resolving the disputes could not provide.

Object of getting the dispute settled through Arbitration is to bypass lengthy procedure invoked in civil cases.

Thus, where there is existence of Arbitration clause in the contract the party raising the dispute is always under legal obligation to refer the matter to Arbitration to fix responsibility of the opposite party.
